About these terms

Car Truck Clubs (www.cartruckclubs.com) is run by Sargent Interactive LLC ("we", "us"). These Terms apply when you use the site. You accept them when you tick the box on the join form or the Welcome step, and by using the site. If you don't agree, please don't use it. Our Privacy Policy, Cookie Policy and Copyright Policy explain more and are part of these Terms.

Who can use Car Truck Clubs

• You must be 13 or older to create an account.
• If you're under 18, you need permission from a parent or guardian, and they agree to these Terms for you.
• If we learn that an account belongs to someone under 13, we will delete it. Parents can contact us at privacy@sargentinteractive.com.
• You can't use the site if we've banned you, or if the law where you live doesn't allow it.

Your account

• Give accurate details and keep them up to date. One person per account.
• Keep your password private. You're responsible for what happens on your account.
• Tell us right away at terms@sargentinteractive.com if you think someone else has used your account.

What you post

You keep ownership of the photos, text, video links and other content you post. To run the site, you give us a non-exclusive, worldwide, royalty-free license to store, copy, resize, format, display and distribute that content on Car Truck Clubs and in the site's emails and notifications. The license ends when you delete the content or your account, except for copies kept for a limited time in backups, or where the law requires us to keep them.

When you post something, you promise that:

• you own it, or have permission to post it (for photos, usually that means you took them);
• it doesn't break the law or anyone else's rights, including copyright, trademark and privacy;
• it follows the community rules below.

Community rules

Don't use Car Truck Clubs to:

• break the law, or promote street racing, stunts on public roads or other dangerous or illegal driving;
• harass, threaten, bully or discriminate against anyone, or post hateful or sexually explicit content;
• post other people's personal information (such as home addresses or phone numbers) without their permission;
• impersonate anyone, or mislead people about who you are or who runs a club or event;
• spam, advertise without permission, or run scams;
• upload malware, try to get around our security or limits, or collect data from the site with bots or scrapers without our written permission.

Clubs and events

Clubs and events are created and run by members, not by us. Organizers are responsible for their club pages, who they approve, and for their events, including permits, venue rules, safety and accurate details. We don't organize, supervise, inspect, insure or endorse any club, event, meet, cruise, show or track day listed on the site.

Car events and motorsport carry real risks, including injury, death and damage to vehicles. If you go to an event or drive at a venue, you do so at your own risk and are responsible for following the law and the organizer's and venue's rules.

Track and museum information comes from public sources and members, and may be out of date or wrong. Check with the venue before you go.

Moderation

We can remove or hide content, and suspend or close accounts, that we believe break these Terms or the law, or that put people or the site at risk. You can report content with the Report button. If you think we got a decision wrong, email terms@sargentinteractive.com.

Copyright and trademarks

We respond to copyright notices as described in our Copyright Policy, and we close the accounts of repeat infringers. Venue logos and names belong to their owners and are shown only to identify the venue.

Other companies' services

The site links to and works with services run by others, such as Google sign-in, YouTube videos you choose to allow, maps and calendar links, and venue websites. Their own terms and privacy policies apply when you use them, and we aren't responsible for them.

Ending your account

You can stop using the site at any time, and ask us to delete your account at privacy@sargentinteractive.com. We may suspend or close an account as described under Moderation. Sections that by their nature should continue (such as what you post, disclaimers, limits of liability and disputes) still apply after an account closes.

Disclaimers

Car Truck Clubs is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including about accuracy, availability, fitness for a particular purpose and non-infringement. We don't check everything members post, and we aren't responsible for members' content or conduct, online or at events.

Limits on our liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the site, other members' content or conduct, or any club or event. Our total liability for all claims relating to the site is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose. Some places don't allow these limits, so they may not all apply to you.

Your responsibility to us

If someone makes a claim against us because of content you posted, your breach of these Terms, or your conduct at an event you found through the site, you agree to cover our reasonable costs of that claim, to the extent the law allows.

Disputes

These Terms are governed by the laws of the State of Alabama, without regard to its conflict of laws rules. Before filing a claim, please contact us at terms@sargentinteractive.com so we can try to resolve it informally. Any claim that isn't resolved must be brought in the state or federal courts located in Madison County, Alabama, and you and we agree to the jurisdiction of those courts. Either of us may instead bring a claim in small claims court if it qualifies.

Changes to these Terms

We may update these Terms. We'll post the new version here with a new effective date, and tell signed-in members on the site or by email before important changes take effect. If you keep using the site after that, the new Terms apply. If you don't agree, you can close your account.
